TCEQ Public Comments on Proposed Rule Changes

The time has arrived for public input on the proposed rule changes. If you are not aware of the rules update process that began in 2017, please read "Proposed Rule Change Process To Date" below.
 
The Public Comment Period begins on January 31st and ends on March 3rd. TXIA would highly suggest accessing the link and reading the "Proposed Rule Changes and Staff Recommendation to TCEQ Commissioners" below.
 
Options and instructions for public comment:
  • The commission will hold a public hearing in Austin on February 27, 2020 at 2:00 p.m. in Building E, Room 201S at the commission's central office located at 12100 Park 35 Circle. The hearing is structured for the receipt of oral or written comments by interested persons.
  • Written comments may be submitted to Andreea Vasile, MC 205, Office of Legal Services, Texas Commission on Environmental Quality, P.O. Box 13087, Austin, Texas 78711-3087, or faxed to (512) 239-4808. All comments should reference Rule Project Number 2018-004-344-CE.

Proposed Rule Change Process To Date
 
You may recall the 2017 Proposed Rule Changes where TCEQ held Stakeholder meetings across Texas gathering input on the classification of irrigation systems as health hazards, eliminating the use of double check valves, etc. After much feedback received, TCEQ staff made their recommendation to TCEQ Commissioners. 
 
 
During the November IAC meeting it was noted that even though the rule petitions set forth by the IAC were recommended to the Commissioners with revisions, during the Public Comment Period, the proposed classification of irrigation as a high health hazard as well as other rule change proposals can be presented once again and be reconsidered. 
 
Important dates to note regarding public input to be taken into consideration before final adoption of proposed rule changes are as follows:
 
  • Proposal – 01/15/2020
  • Public Comment Period – 01/31/2020 - 03/03/2020
  • Adoption – 07/01/2020
